Festival information listed on Everfest may be impacted by COVID-19.
a) Everfest Premium. Everfest provides an optional Premium service as a paid subscription service (“Paid Subscription”, "Premium Subscription", “Subscription” or “Service”; formerly "FestLife") that offers Subscribers access to Perks from Everfest Partners.
b) Subscriber. A Subscriber is an Everfest member who at some point in time has had an active Subscription to a Premium Subscription.
c) Partners. Partners may include but are not limited to festivals, concerts and providers of services ancillary to festival attendance.
d) Perks. Partners provide Perks to Subscribers. Perks may include but are not limited to: early access to tickets, discounts on tickets and services, free or discounted merchandise, access to exclusive on-event experiences.
e) Claiming Perks. Subscribers with an active Subscription may claim Perks from Partners via the Everfest website and mobile applications. Everfest does not guarantee the availability of Perks except where explicitly noted on the website. Some Perks may have limited quantities and will be noted as such on the website. In some cases, Claiming may only grant Subscribers access to a limited Perk, i.e. a ticket presale with a limited number of tickets. In this case, the Subscriber Claims a code granting them presale access, at which point ticket sales would be first come, first served until supplies are exhausted.
f) Redeeming Perks. A Subscriber must have an active Subscription to Claim Perks, but does not necessarily need to have an active Subscription at the time the Perk is redeemed. For example, if discounted tickets go on sale in January for a festival that takes place in March, a Subscriber may claim the Perkin January, but if their Subscription expires and is not renewed in February 1, they may still redeem the Perk at the festival in March.
g) Service Fees. As a paid user of the Service, you are subject to Subscription fees disclosed to you at the time of purchase and that may be discounted from time to time for special promotional programs. The features and functionality of each version or service level may be changed from time to time at Everfest's discretion. If you subscribe to use a paid version of the Service on a free-trial basis and you do not cancel the trial before the expiration then, upon the expiration of the trial period, your account will be automatically converted to a paid account and your designated payment method will be billed (“Payment Method”). Unless stated to the contrary, all charges for paid versions of the Service are non-refundable, even if your use of the paid version of the Service is cancelled before the end of your current billing period.
h) Fee Changes. Everfest may change the price for the Paid Subscriptions from time to time, and will communicate any price changes to you in advance, if applicable. We continually update and test various aspects of our platform. We reserve the right to, and by using our service you agree that we may, include you in or exclude you from these tests without notice. Unless we expressly communicate otherwise, any price changes will take effect on your next billing cycle upon notice communicated through a posting on the Everfest website or such other means as we may deem appropriate from time to time, such as email. As permitted by local law, you accept the new price by continuing to use the Service after the price change takes effect. If you do not agree with the price changes, you have the right to reject the change by unsubscribing from the Service by contacting us at customer service prior to the price change going into effect. Please therefore make sure you read any such notification of price changes carefully.
i) Subscription Cycles. Your Subscription starts on the date that you sign up for a Subscription and submit payment via a valid Payment Method. Each cycle is one year in length (a “Subscription Cycle”), and will automatically renew until your membership is cancelled or terminated. Your renewal period will be equal in time to the renewal period of your Subcription Cycle. Your renewal date may change due to changes in your Subscription. The duration of your Subscription Cycle is not impacted by your Billing Cycle, i.e. if you choose monthly billing, you are still responsible for payment for the full one-year Subscription Cycle.
j) Billing. You must provide us with a current, valid, accepted method of payment to use the Service. We will automatically bill the applicable fees using your Payment Method. Any additional discounts or refunds that we may choose to provide are in our sole discretion and do not entitle you to any future discounts or refunds in the future.
k) Trials. From time to time we may offer a trial Subscription that includes standard access to the Service during the trial period. Each trial Subscription automatically will convert to a paid Subscription unless canceledprior to the end of trial or as otherwise specified in the trial offer. Unless we expressly communicate otherwise, trial Subscriptions are only available to new customers that have never had a Paid Subscription before, are not transferable, may not be combined with other offers or redeemed for cash and are void where prohibited.
l) Service and Advertisements. Our Service may change from time to time and/or we may stop (permanently or temporarily) providing the Service (or features within the Service), possibly without prior notice to you. Our Service may, at some point, include advertisements, which may be targeted to the content or information on the Service, queries made through the Service, or from other information. The types and extent of advertising on the Service are also subject to change over time. In consideration for providing you the Service, you agree that we and our third party providers and partners may place advertising on our Service or in connection with the display of content or information on our Service.
m) Currency. All prices for memberships in the United States are stated in U.S. Dollars.
n) Payment Methods and Security. Everfest uses Stripe as its payment processor and accepts several methods of payment to accommodate your needs. We don't store your credit card information, instead we rely on Stripe to store this information for you. For recurring membership charges, we use your Stripe customer ID that's created through our system to process the payment. More information about this can be found on the Stripe website.
o) Payment Terms. The terms of your payment will be based on your Payment Method and may be determined by agreements between you and the financial institution, credit card issuer or other provider of your chosen Payment Method. By subscribing to the Service or submitting an order for other paid services offered through Everfest, you authorize Everfest, or its designated payment processor, to charge our Payment Method for all fees and other charges you may incur in connection with your use of the Everfest Service. Everfest may suspend or terminate the Services if fees are past due.
p) Cancellations. All Everfest Premium subscriptions are a one-year membership commitment, lasting for a full 12-month period (Subscription Cycle), regardless of billing cycle. Members may choose to be billed monthly, but are still responsible for the full price of the one-year membership.
While you may cancel your account at any time, such that your annual subscription does not automatically renew for the following year, Everfest is not able to offer refunds if (a) you have claimed and/or redeemed a Premium perk or discount or (b) 10 or more days have passed since you began your one-year Everfest Premium subscription.
Everfest offers a 10-day courtesy refund grace period for Everfest Premium members who have purchased their one-year subscription AND have not claimed and/or redeemed a perk or discount in the Premium program. Please contact us at email@example.com within 10 days of your Premium purchase and we will refund your subscription to the card used to purchase. Please note that refunds may take up to 10 days to be processed by our payment processor.
If you have chosen a monthly billing cycle for your one-year membership and do not meet the requirements for a courtesy refund as described above, you will remain responsible for the full 12 payments. If you would like your account to be closed immediately, you will need to contact us at firstname.lastname@example.org to pay off the remaining balance of your one-year subscription.
Additional Terms for Refunds/Cancellations. Some countries have mandatory local laws regarding your cancellation rights, and these terms do not override such laws. Refunds are only issued if required by law. For example, users living in the European Union have the right to cancel their Paid Subscriptions within 14 days of signing up for, upgrading to or renewing a Paid Subscription.
q) Premium Membership rules: Individuals are only allowed to maintain one Premium membership and Everfest may utilize a variety of methods to confirm your identity in this regard. Any attempt to open and maintain multiple Premium accounts may result in the cancellation of your additional accounts without a refund. In addition, all claimed perks must be used by the individual who maintains the Everfest Premium Membership, unless specifically noted on the perk (ie, "bring a friend with you"). Premium members are expressly not authorized to sell claimed perks, including but not limited to tickets purchased at a discount or promotional rate, to any other individuals. Everfest may cancel your account and charge a misuse fee of up to $100 if we receive information that you have engaged in activity related to selling claimed perks for a profit. Premium members found in violation of any of the above terms will have their accounts cancelled without refund and, if on the monthly payment plan, the remaining payments due will be charged at the time of cancelation.
